What Is Probate And What Are The Duties?
Probate is the court-supervised process for the disposition of a person’s estate when they die. As the personal representative of the estate, your probate and estate administration responsibilities may include:
- Opening the estate in probate court
- Gathering the assets of the deceased
- Paying taxes and debts of the estate
- Liquidating property if necessary to pay creditors
- Distributing the remaining assets to heirs and beneficiaries
- Final accounting and reporting requirements
What Is Trust Administration?
Assets held in a trust bypass the probate process. Instead, an appointed administrator (trustee) manages the trust fund. It’s a complex and daunting responsibility. I provide close counsel to help you carry out your duties and avoid legal trouble for “breach of trust.”
Trust administration may include managing investments, transferring real estate, filing annual taxes, making distributions to beneficiaries, and maintaining a detailed accounting. Some trusts are dissolved shortly after the person’s death once all assets are distributed. Other trusts are an ongoing commitment, doling out assets in annual increments and requiring fund management and reporting. With three decades in this field, I am well-versed in all types of trusts and the legal obligations.
